Understanding
the laws
regarding discrimination and Forbidden Advertising Words
It’s important for you to be
thoroughly familiar with the strict sanctions against discrimination in
the federal Fair
Housing Law (Title VIII of the Civil Rights Act of 1968, amended by the
Housing
and Community Development Act of 1974) and the Equal Credit Opportunity
Act.
Real Estate Agents, Mortgage professionals and homeowners may not
refuse to sell, rent, deal or negotiate with a person because of his or
her race, color, religion, sex, marital status, national origin, or
receipt of public funds or assistance. You need to be aware of the Fair
Housing Act so you
will not take any action that is in violation of the act.
Discriminatory activities
include:
Refusing to sell or rent
dwellings. Imposing
different terms and conditions of sale or rental. Falsely denying the
availability of housing for sale or rental. Refusing to make mortgage
loans. Harassing or intimidating persons exercising fair housing rights
based on race, color, religion, sex, disability, familial status or
national origin.
Complaints are filed with the
United States Department of Housing and Urban Development (HUD). They
are charged with the enforcement of the Fair Housing Act.
All real estate advertising
whether in
print or on the Internet (World Wide Web) is subject to the Federal
Fair
Housing Act. It is illegal to advertise any preference, limitation or
discrimination
based on race, color, religion, sex, sexual orientation, marital
status,
handicap, familial status, ancestry, or national origin, or intention
to
make any such preferences, limitation or discrimination.
